The objective of these changes is to clarify and strengthen the regulatory guidance, providing more specific provisions for how pepper spray can be used by the Department of Corrections in prisons to ensure it is safe and lawful. The first change amends the Regulations to explicitly define what delivery mechanisms can be used to deploy pepper spray. This means that any new mechanisms that Corrections seeks to use in the future need to be approved by Cabinet. Corrections believes this provides more transparency to the way pepper spray is used in our prisons, and provides more assurance as to the safety of these delivery mechanisms because of the new requirement for Cabinet approval. The second change clarifies that the prison director is responsible for decisions around issuing pepper spray in planned incidents. The third change reiterates that non-lethal weapons must only be used when reasonably necessary, in accordance with the general guidance on force in the Corrections Act 2004. The Cabinet paper also outlines changes to enable the copying of prison mail. These changes will allow prisoner mail to be copied for various purposes, including reducing the administrative burden that sometimes requires that original mail be couriered between sites. Corrections believes that this change will provide for more efficient processing of mail, especially when dealing with illicit or harmful material, and in turn, ensures that our sites remain secure, and that people in prison continue to have ongoing access to a mail system that supports connection with friends, whānau, and the wider community. |
